What a Texas Last Will Can Address

A will directs the distribution of property that passes through the probate estate. It can also identify who should carry out your instructions and establish how certain beneficiaries receive their inheritances.

Common will provisions include:

• Beneficiaries: Name the individuals or organizations intended to receive probate property.
• Executor: Identify the person nominated to administer the estate, address valid obligations, and distribute property under the will.
• Guardian nomination: State your preference for a guardian for minor children if one becomes necessary.
• Specific gifts: Provide instructions for particular property or amounts left to named beneficiaries.
• Testamentary trust: Create a trust through the will for a minor child or another beneficiary when distribution over time is more appropriate than an immediate transfer.

A will generally doesn’t control every asset. Life insurance, retirement accounts, payable-on-death accounts, jointly owned property, and assets held in a trust may pass according to beneficiary designations, ownership terms, or other documents. Coordinating these arrangements can prevent the will from conflicting with how an asset is legally transferred.

Texas Requirements for Signing & Witnessing a Will

As a general matter, the Texas Estates Code requires an attested will to be in writing and signed by the person making it, known as the testator, or by someone acting in the testator’s presence and at the testator’s direction. It generally must also be witnessed by at least two credible witnesses who are 14 or older and sign in the testator’s presence.

Texas also recognizes certain wills written entirely in the testator’s handwriting, subject to statutory requirements. Although a handwritten will may be valid, unclear language or incomplete instructions can create questions during probate.

A self-proving affidavit is a sworn statement confirming that a will was signed with the required formalities. When properly completed, it can allow a qualifying will to be admitted to probate without testimony from the subscribing witnesses. Because execution requirements depend on the document and circumstances, online forms aren’t a substitute for individualized legal guidance.

• Marriage or divorce
• The birth or adoption of a child
• The death or incapacity of a beneficiary or nominated executor
• A move to or from another state

• Changes in guardianship preferences for minor children
